The Nation : N.Y. Bike Ban Overruled

A state judge threw out New York City’s attempt to ban bicycles from the heart of Manhattan, but city officials vowed to find a way to stop bicycle traffic. The 90-day ban, which would have kept cyclists off 5th, Madison and Park avenues in midtown in the middle of the day, was an effort to reduce accidents. State Supreme Court Justice Edward Lehner ruled the ban was invalid because it came as an order by the city transportation commissioner rather than as a regulation, which would be published in the city record and permit the public to comment, as required by the city charter.
