No Oil Inc. on Wednesday petitioned the state Court of Appeal to overturn a lower court ruling that permits a drilling measure backed by Occidental Petroleum Corp. to appear on the Nov. 8 ballot.
Roger Jon Diamond, president of No Oil, challenged Los Angeles Superior Court Judge Miriam A. Vogel’s decision that the Occidental-backed measure should be placed before voters despite allegations that it may lead to confusion.
Diamond and other anti-drilling advocates have sponsored a rival measure that would overturn three drilling ordinances passed in 1985 that authorize Occidental to search for oil in Pacific Palisades. Drilling opponents have argued that the rival measure, which does not specifically mention Occidental in its language, will be mistakenly supported by voters opposed to drilling near the beach.
The petition, filed with the 2nd District Court of Appeal in Los Angeles, seeks an order removing the pro-drilling measure from the ballot.
