U.S. Supreme Court Overturns ‘Opinion Defense’ in Libel Cases

One lesson to be learned from the Rehnquist court’s defamation decision--especially for Californians critical of our state Supreme Court under Rose Bird--is that judicial activism is pernicious whether it dresses in liberal or conservative robes.
Of course, its effect is far more dangerous when it discourages the exercise of a fundamental constitutional right of every American--in my opinion.
