Burglary Suspect May Face ‘3rd Strike’

An armed burglary suspect faces the possibility of a “third strike” conviction after he was arrested in a botched robbery attempt, police said Wednesday.
Marion Netherly entered a residence near Vena Avenue and Kagel Canyon Street at 9:43 p.m. Tuesday, and a woman in the house discovered him, said Los Angeles Police Lt. Jeff Hulet of the Foothill Division.
Netherly “pulled out a handgun and pointed it at the woman, who managed to get to another room in the house and call police,” Hulet said. “When officers arrived, [Netherly] fled . . . but was caught by police about a block from the house.”
No property was taken from the house, but police recovered a 9-millimeter handgun they believe Netherly dumped as he attempted to flee, Hulet said.
Netherly is a parolee who previously had been convicted for burglary and robbery, Hulet said. He now may face charges of assault with a deadly weapon, which could be his third strike.
The suspect suffered minor injuries after being bitten by a police dog, Hulet said.
The woman and her children, who were also home at the time of the incident, were not injured, he said.
